Mount Pleasant Police Car

Mount Pleasant police say a 23-year-old Butler man had at least two children in the car with him when he was arrested for marijuana possession after he went through a McDonald’s drive-thru.

Brandon Wagner had a complaint filed against him Thursday in Racine County Circuit Court with possession of marijuana. If convicted, he faces up to six months in jail and/or up to $1,000 in fines.

According to the criminal complaint, at 12:22 a.m. Wagner was going through the drive-thru at McDonald’s, 13343 Washington Avenue, when an employee saw him yelling and turned around toward the back seat. The witness told police it appeared he was shaking a child, and they heard a young boy say he wanted his mommy.

When officers arrived, Wagner gave them permission to speak to the children. Police say they could smell marijuana, and when they questioned Wagner, he admitted there were drugs in a glove. He also admitted to smoking marijuana, and officers say his speech was slurred and his eyes were glassy and bloodshot.

Wagner was transported to the Mount Pleasant Police Department and questioned further. Officers noted that Wagner appeared confused and unable to keep up with the conversation, but he did admit to smoking marijuana while he was in Milwaukee before he went to West Allis to pick up the children.

The criminal complaint does not indicate why Wagner drove to Racine or in whose custody the children were released at the time of Wagner’s arrest. He submitted to a legal blood draw, but the results are not listed in Wagner’s complaint.
