A Wind Lake couple is accused of election fraud for voting more than once and registering to vote in more than one place in the April 2017 election.
James K. and Kay E. Denig are each charged by the Racine County District Attorney’s Office with two felony counts that could bring a total fine of $20,000 and seven years in prison. They will return to Racine County Circuit Court on May 17 for an 8:30 a.m. preliminary hearing.
According to the criminal complaint:
In September 2017, an investigator with the Racine County Sheriff’s Department was provided with records from both Burlington and Rochester that showed the defendants’ signatures. The defendants allegedly voted in the town of Burlington and the village of Rochester.
James Denig told police that he had sold his Rochester house at the end of September. The home in Burlington had been owned as a family lake house for several years. The Denigs admitted they voted on the full ballot in Rochester, then drove to Burlington to vote just on referendums.
Kay Denig stated she saw the 10-day residency requirement on the registration form, however, she thought it meant that she needed to own the house for 10 days prior to voting, which she had fulfilled.
