A 23-year-old man was charged with two felonies for striking a pedestrian with his car and having drugs.

James A. Lubinski was charged by the Racine County District Attorney’s Office Thursday with felony counts of possession of cocaine and operating while intoxicated causing injury.

The cocaine charge carries a fine of $10,000 and three years, six months in prison, while the second felony carries a fine of $10,000 and six years in prison.

According to the criminal complaint:

An officer observed a red Ford Sedan westbound toward Main Street travel up onto the curb and barely miss a traffic signal. The officer also saw a male yell and jump out of the way. The vehicle continued on the curb line and struck a utility pole.

The male told police he was folding his chair after the parade when he was struck on the lower left leg by the Sedan.

Police spoke with Lubinski, who they observed as very lethargic with slurred speech. He admitted to having a couple beers and blurted out: “I did it. I hit that guy. Is he alright?” He also said, “I’ve done this before. I don’t want to do it again. I don’t want to incriminate

A portable breath test revealed a blood alcohol content of 0.17. Police also found a baggie with 4.3 grams of what tested positive for cocaine in his right front pants pocket.

A preliminary hearing was set for 9 a.m. Thursday in front of Racine County Court Commissioner Alice Rudebusch.
