A 41-year-old Racine man faces a felony charge in the alleged sexual assault of his wife Sunday.
The felony was filed Monday in Racine County Circuit Court against the man. He is not being named to protect the victim’s identity. The charge carries a fine of $100,000 and 40 years in prison.
The man also is charged with a felony count of strangulation and suffocation, and four misdemeanor counts of bail jumping, criminal damage to property and disorderly conduct.
The second felony carries a fine of $10,000 and six years in prison. The misdemeanors carry a total fine of $51,000 and three years, 10 months in county jail.
According to the criminal complaint:
Racine police were dispatched to a residence after a child called stating her parents were fighting and her stepfather was raping her mother. She also said he broke her phone and threatened to kill her before he left the scene.
When an officer arrived, he spoke with the woman, who appeared to be crying.She had a raspy voice and held her neck the entire time. She stated she went to bed and woke up with no pants or underwear on and with her husband straddling her with both hands clenched around her neck. The woman said she came close to losing consciousness, and that the defendant kept his hands around her neck for about five minutes.
Police found the defendant sitting on the corner of Taylor Avenue and Pierce Boulevard. He told police that he and his wife had consensual sex. At one point, he heard her phone go off and saw it was a text message from another man. The defendant stated he broke her phone but denied holding her down or strangling her. He also claimed she had struck him several times in the face, but police didn’t find any injuries.
The defendant is due back in court Sept. 6 for an 8:30 a.m. preliminary hearing.
