An inmate at the Racine County Jail faces new charges after an incident Monday night.

Destiny E. Payne, 21, is charged with a felony count of assault by a prisoner, along with misdemeanor counts of resisting an officer, disorderly conduct and three counts of bail jumping.

The felony carries a fine of $10,000 and three years, six months in prison. The misdemeanors carry a total fine of $41,000 and three years, three months in county jail.

According to the criminal complaint: A deputy with the Racine County Sheriff’s Department who was on duty at the jail observed Payne flooding her holding cell by repeatedly flushing the toilet. The water spilled into the dayroom, which caused other inmates to stand on their bunks to avoid getting wet.

After officers were able to detain Payne, she refused to follow orders, and had to be further restrained. As they attempted to carry her to a cell, she spit into one of the officer’s eyes.

Court records indicate that Payne has a pending felony case that charges her with two counts of threats to a law enforcement officer, along with several misdemeanor cases.

Payne is due back in court for a preliminary hearing Nov. 7 at 8:30 a.m.
