A Racine man stands accused of waving a gun around and pointing it at people while he was a passenger in a car on Wednesday afternoon about 1,000 feet from St. Catherine’s High School.
Daiviontae Tyrell Johnson, 21, of Racine, was charged by the Racine County District Attorney’s Office with possession of a firearm by an out-of-state felon. If convicted of the charge, Johnson faces up to 10 years in prison and/or fines up to $25,000.
According to the criminal complaint, an officer with the Racine Police Department responded to 16th and Racine St. at 1:20 p.m. Wednesday to a report of a person in a car waving a gun around at people. The officer conducted a high-risk traffic stop in the 1200 block of Villa Street about 1,000 feet from St. Catherine’s High School.
At gunpoint, the officer ordered Johnson to get out of the red Impala and walk back towards him. Johnson was the passenger in the car. When officers searched the car, they found a loaded .40 caliber semi-automatic handgun underneath the seat of where he had sat.
Johnson told police a person did have a gun in the car, but they were dropped off before police stopped them. The driver, however, told police that Johnson had the gun and he was waving it around. Johnson then told police he wasn’t going to lie, there were photos of himself holding guns on his phone.
A records check of Johnson showed that he was convicted of robbery in Clay County Florida in 2014.
Racine County Court Commissioner John Bjelajac set a $2,000 cash bond. He is due back in court for a preliminary hearing at 8:30 a.m. April 25.
