Racine County Sheriff’s deputies say a 25-year-old man is facing misdemeanor drug charges after they found marijuana in his car following an accident on I-94.

Brandon Green, of Battle Creek, MI, was charged Friday in Racine County Circuit Court with one misdemeanor count each of marijuana possession and possession of drug paraphernalia. If convicted, he faces up to nine months in jail and/or up to $1,500 in fines.

According to the criminal complaint, deputies were called at 3:28 a.m. to mile marker 333 on I-94 for a report of a single car accident. They were advised the car was resting against the median, and the driver’s door was detached from the car.

When officers arrived, they say two occupants – one of whom was Green – were outside the car. Green told them he was driving when he fell asleep at the wheel. Deputies could detect a faint odor of marijuana and when asked about it, Green admitted to a small quantity in his backpack.

A search of the backpack and the vehicle turned up 16 grams of marijuana, some of which was packaged in three separate plastic baggies, two pipes and hemp rolling papers, the complaint reads. Green admitted to smoking marijuana while he was still in Michigan, about six hours before the accident.

Green remains in the Racine County Jail on a $250 cash bond. He will next be in court June 30 for a pre-trial conference.
