Racine police say a 31-year-old man is behind bars after a young girl told her mother that he touched her “in bad ways” while the mom wasn’t home.

Michael Sherrill, of Racine, was charged Wednesday in Racine County Circuit Court with one felony count of Michael Sherrillfirst degree sexual assault of a child under the age of 12. If convicted, he faces up to 60 years in prison. Because he is considered a repeat offender for previous drug convictions, Sherrill could get extra time tacked on to any sentence he might receive.

According to the criminal complaint, police were called Sept. 23, 2014 to a home for a report of a sexual assault of a young girl. When investigators talked to the girl she said she was asleep on top of her covers in a nightshirt. She wasn’t wearing undergarments, she said, because she didn’t have any that were clean.

Police say the girl told them Sherrill sat on her bed and started touching her under the nightshirt. The girl said she moved away from Sherrill and pulled the covers over her because she was afraid Sherrill would hurt her. After he left her room, the girl went to her brother’s room and contacted her mother on Facebook and asked when she would be home. The girl said that Sherrill was drunk and not walking straight.

The woman told officers that when she got home, she kicked Sherrill out of the house, the complaint reads.

At the time, Sherrill maintained that the girl made up the story and fled the state. When he returned, officers arrested him on Nov. 25, 2015. They say they found him back at the house where the assault took place, but he said he was so drunk at the time that he urinated on himself and had no memory of anything inappropriate.

Sherrill remains in the Racine County Jail on a $75,000 cash bond and is ordered to submit a DNA sample, not possess or consume any alcohol and not have any contact with the girl, her residence and/or her family. He will next be in court Dec. 9 for his preliminary hearing.
