RACINE — A Florida man headed back home early last month instead found himself with a felony drug charge.

Kevin Freund, 37, is charged with felony possession with intent to deliver marijuana after a search of his vehicle revealed more than 775 grams of marijuana.

If convicted of the felony, Freund faces a total possible prison term of six years and a $10,000 fine. Freund, who also is charged with misdemeanor possession of marijuana, remains free from custody on a $5,000 signature bond.

The criminal complaint: Routine traffic stop brings felony charges

A deputy with the Racine County Sheriff’s Office was on patrol on March 4 on I-94 near Highway K, when he stopped the defendant’s Toyota Tacoma for having a suspended registration.

When the officer made contact with Freund, who stated he was driving back to Big Pine Key, Fla., he noted an odor of marijuana coming from the vehicle. The officer also found a vape pen in plain view in the center console.

The officer ordered Freund to exit the vehicle, but he resisted, the complaint states. The defendant eventually exited, but claimed there was “no marijuana in the vehicle.”

Police found the vape pen in the center console, along with two clear jars with THC wax that weighed about 100 grams. In a backpack on the rear driver’s seat, police located a vacuum-sealed bag that contained 443.4 grams of marijuana, along with another vacuum-sealed bag with 10 individually packaged bags of marijuana that weighed 325.7 grams.

In the back pocket of the passenger seat, police found a clear plastic bag of 6.4 grams of marijuana.

The deputy noted in the complaint his belief that, because of how the marijuana was packaged and because of its quantity, it was for resale and not personal use.

Freund is due back in Racine County Circuit Court on May 15 for a 9 a.m. status conference.
